			<content:encoded><![CDATA[<div>At the <span id="yiv780218851yiv526340608lw_1283128786_5" style="BACKGROUND: none transparent scroll repeat 0% 0%; CURSOR: hand; BORDER-BOTTOM: medium none"><span id="yiv780218851lw_1283271527_1"><span id="lw_1283356045_3">Baytown City Council</span></span></span> public hearing about the red light camera initiative petition on 8-24-10 Byron Schirmbeck, (director of <a rel="nofollow" href="http://saferbaytown.com/" target="_blank"><span id="yiv780218851yiv526340608lw_1283128786_6">saferbaytown.com</span></a>), presented to city officials the accident data reported by <span id="yiv780218851lw_1283271527_2" style="CURSOR: hand; BORDER-BOTTOM: #366388 2px dotted">Baytown</span> <span id="yiv780218851yiv526340608lw_1283128786_7"><span id="yiv780218851lw_1283271527_3">Police Department</span></span> to TXDOT indicating a dramatic increase in accidents at camera monitored intersections this past year. After hearing the report the mayor, Stephen DonCarlos, asked police chief Dougherty to provide them with an &#8220;apples to apples&#8221; comparison of the two most recent accident reports. Some suggestions were to see if the increases in certain types of accidents in the 2010 report were due to other &#8220;contributing factors&#8221; such as road conditions or drivers using their cellphones. While we welcome impartial, accurate comparisons of the data we question why city officials have decided to scrutinize the most recent report which shows dramatic increases in accidents at red light camera locations when no such scrutiny was suggested for the previous 2009 report to TXDOT which the city cited as proof of a decrease in certain types of accidents directly attributable to the red light camera program.</div>

<div>The 2009 report appeared, on the surface, to be favorable to the camera program. In fact, taking the 2009 report at face value, the city manager stated to the <span id="yiv780218851yiv526340608lw_1283128786_8"><span id="yiv780218851lw_1283271527_4"><span id="lw_1283356045_4">Baytown sun</span></span></span> on 3-27-10 that “By any measure this program has been successful and it is changing the way Baytownians travel through intersections,” and clearly indicated that the 2009 report was an accurate view of the camera program&#8217;s performance saying, &#8221;the cameras have reduced accidents at the nine locations where they have been installed.&#8221; based, apparently, on the data in the Baytown Police department&#8217;s 2009 report to TXDOT. The statistics from the 2009 report were directly quoted as evidence of the camera program&#8217;s performance. I presented the 2010 report to the council in the exact same manner as the city presented the 2009 report to the public, at face value and as a sure indicator of the performance of the camera program. It was after my presentation showing a clear and large increase in accidents at camera locations that the mayor and some members of the council expressed their concerns about the reliability of the data and whether or not it was a true indication of the cameras&#8217; performance or not.</div>

<div>There was no indication in the <span id="yiv780218851yiv526340608lw_1283128786_9"><span id="yiv780218851lw_1283271527_5"><span id="lw_1283356045_5">Baytown Sun article</span></span></span>, or in any other public disclosure that we have found that there could be &#8220;contributing factors&#8221; to the decrease in accidents reported in 2009 such as <span id="yiv780218851yiv526340608lw_1283128786_10"><span id="yiv780218851lw_1283271527_6"><span id="lw_1283356045_6">road closures</span></span></span> or construction, decreases in <span id="yiv780218851yiv526340608lw_1283128786_11" style="BACKGROUND: none transparent scroll repeat 0% 0%; CURSOR: hand; BORDER-BOTTOM: medium none"><span id="yiv780218851lw_1283271527_7"><span id="lw_1283356045_7">traffic volume</span></span></span> or the well known fact that drivers tend to avoid camera locations by taking another route or cutting through adjacent parking lots. We can find no pleas for caution or any indication that there would or should be a scrutinization of the 2009 data similar to what they suggest should be done with the 2010 report. Taken at face value, the 2010 report showed a 40% increase in total accidents, a 75% increase in injury accidents, an 83% increase in rear end accidents and a 37% increase in right angle accidents caused by red light runners. These statistics are more dramatic than the small decreases in the 2009 report. While police chief Dougherty did confirm on the record at the hearing that the statistics reported by Schirmbeck were an accurate representation of what was reported to TXDOT by BPD he qualified his answer by saying it was the &#8220;raw data&#8221; and that he would be working on the comparison report as requested by the mayor and the council. Our concern is that this request could be an attempt to find a way to put a positive political spin on the BPD&#8217;s own report which clearly shows an increase in accidents when the previous year&#8217;s report was taken at face value as credible proof of the program&#8217;s performance. We don&#8217;t believe there should be different standards applied to the city&#8217;s evaluation of the red light camera accident data. Certainly, If the 2009 report was an accurate indication of how the cameras affect <span id="yiv780218851lw_1283271527_8" style="CURSOR: hand; BORDER-BOTTOM: #366388 2px dotted">traffic safety</span> the 2010 report is also an accurate indication of how the cameras affect traffic safety. If the 2010 report cannot be trusted then the 2009 report can not be trusted either. We don&#8217;t believe a negative report about the red light cameras should be viewed in a different fashion than a positive report.</div>
<div> </div>
<div>Mayor DonCarlos said the people deserve to know the facts so they can make an educated decision in the election this November, clearly indicating that any comparison report done by the city would be intended to be reviewed by voters to help make their decision about whether they vote to keep the program or to ban it. We certainly agree the people should have the facts, but we wonder what facts the city (which netted $3.4 million according to the article) will present to the people when there appears to be one standard for favorable reports and another for unfavorable reports.</div>

<div>We urge the city to have the analysis done by a disinterested third party and any factors for scrutinizing the data be applied evenly across the reports for 2009 and 2010 as well as the pre-installation accident report. We request that the same analysis be done for non camera monitored intersections as a comparison to the camera monitored intersections as city wide accidents appear to be declining at non monitored intersections during the same time period accidents are rising at camera monitored intersections. We request that the city publish the results, methodology, criteria and standards for any comparison report. We also request that the analysis account for traffic volume across all data sets including the pre installation data for the most accurate comparison. Any further application of different standards, or an incomplete report with selective criteria could indicate a deliberate manipulation of the data for the political means of influencing the vote in November.</div>

<p> City offices, including those at City Hall, Public Works, and Utility Billing, will be closed Monday, September 6, in observance of Labor Day.  All offices will re-open for business at their regular time on Tuesday, September 7.</p>

<p>All emergency services and residential trash and curbside recycling collection will operate as usual on Monday. Street and utility crews will be on stand-by in the event of an emergency.</p>

<p>City parks, including the Roseland Spray Park, the Baytown Nature Center and both skate parks will remain open. Pirates Bay Waterpark will be open Saturday, Sunday and Monday from 11 am – 7 pm.</p>

<p>The Baytown Green Center will be closed Saturday &#8211; Monday; the Sterling Municipal Library will be closed Sunday and Monday; and the Eddie V. Gray Wetlands Center and Baytown Community Center will both be closed Monday.</p>

<p style="margin: 0in 0in 0pt;"><span style="font-family: 'Palatino Linotype';" lang="EN"><span style="font-size: small;">City of Baytown</span><span style="font-size: small;"> and Baytown Area Water Authority (BAWA) customers might temporarily notice something a little different about their water. As part of the agency’s ongoing efforts to maintain the delivery of high quality drinking water, BAWA will temporarily change the disinfectant used from chloramines to free chlorine. This event, which will begin September 13, is a standard maintenance practice proven to prevent future <span id="lw_1283356045_3">water quality issues</span> in the distribution system. </span></span></p>
<p style="margin: 0in 0in 0pt;"><span style="font-family: 'Palatino Linotype';" lang="EN"><span style="font-size: small;"> </span></span></p>
<p style="margin: 0in 0in 0pt;"><span style="font-family: 'Palatino Linotype';" lang="EN"><span style="font-size: small;">BAWA uses chloramines (a combination of chlorine and ammonia) as its primary disinfectant. <span id="lw_1283356045_4">Chloramines</span> provide a stable, long lasting residual within the water distribution system. This maintenance effort by BAWA and the City of Baytown</span><span style="font-size: small;">, will maintain optimal water quality. The water quality from BAWA is consistently rated “ Superior</span><span style="font-size: small;">” by the State of Texas</span><span style="font-size: small;">, the highest quality rating available. This procedure will enhance <span id="lw_1283356045_5">water treatment</span> and improve efficiency by reducing the amount of system flushing required.</span></span></p>
<p style="margin: 0in 0in 0pt;"><span style="font-family: 'Palatino Linotype';" lang="EN"><span style="font-size: small;"> </span></span></p>
<p style="margin: 0in 0in 0pt;"><span style="font-family: 'Palatino Linotype';" lang="EN"><span style="font-size: small;">“Free chlorine, while totally safe to the consumer, is stronger than chloramines as a disinfectant,” said BAWA Superintendent Steven Fife. During this procedure, the system will operate as normal, with the exception of the disinfection process. This is a procedure that BAWA will repeat every three to four years or as necessary to maintain system levels.</span></span></p>
<p style="margin: 0in 0in 0pt;"><span style="font-family: 'Palatino Linotype';" lang="EN"><span style="font-size: small;"> </span></span></p>
<p style="margin: 0in 0in 0pt;"><span style="font-size: small;"><span style="font-family: 'Palatino Linotype';" lang="EN">Fife</span><span style="font-family: 'Palatino Linotype';" lang="EN"> added that while some residents may experience an odor or taste similar to water in a <span id="lw_1283356045_6">swimming pool</span>, the water is safe and meets all <span id="lw_1283356045_7">public health standards</span>. The use of free chlorine and chloramine disinfection is used world wide, and is considered a best operating practice.<span>    </span></span></span></p>

<p>Como parte del continuo esfuerzo de la agencia por mantener un suministro de agua de alta calidad, BAWA cambiará temporalmente de cloraminas a cloro el desinfectante que utiliza. <p><span style="font-family: 'sans-serif';">The Southeast Harris Community Coalition (SEHCC) in collaboration with the <span id="lw_1282851590_2" style="background: none transparent scroll repeat 0% 0%; cursor: hand; border-bottom: #366388 2px dotted;">Texas Alcohol Beverage Commission</span> (<span id="lw_1282851590_3" style="cursor: hand; border-bottom: #366388 2px dotted;">TABC</span>) is announcing its Responsible Beverage Service Campaign throughout the communities of <span id="lw_1282851590_4" style="background: none transparent scroll repeat 0% 0%; cursor: hand; border-bottom: medium none;">Southeast Harris County</span>.  </span><span style="font-family: 'sans-serif';">The goal of this campaign is to reduce underage drinking and other alcohol-related problems in the community.  It will do this by </span><span style="font-family: 'sans-serif';">raising awareness among retail establishments on the consequences of selling alcohol to minors which ultimately will improve compliance rates.</span></p>
<p style="margin-top: 12pt; line-height: 115%;"><span style="font-size: 11pt; line-height: 115%;">Responsible Beverage Service (RBS) is a community-based approach to reducing risks associated with the sale and use of alcohol in retail environments. RBS has three essential elements: policy development, merchant education, and partnerships with law enforcement.  </span><span style="font-size: 11pt; line-height: 115%;">While improving public safety and health, it will also set a higher standard for the hospitality industry and service sector, to support life quality in the community, and to improve the viability of business for establishments that are responsible. </span></p>
<p style="margin-top: 0in; line-height: 115%;"><span style="font-size: 11pt; line-height: 115%;">“Good RBS means that alcohol retailers check ID’s, refuse service to intoxicated patrons, and the community gets involved to ensure safe alcohol service and sales,” said Vanessa Ayala of the Southeast Harris Community Coalition.  “The Coalition will provide information to alcohol retailers to help ensure responsible alcohol sales.”</span></p>
<p style="line-height: 115%;"><span style="font-size: 11pt; line-height: 115%;">The SEHCC continues to participate in compliance check operations with the <span id="lw_1282851590_5" style="background: none transparent scroll repeat 0% 0%; cursor: hand; border-bottom: medium none;">local police department</span>, TABC and other area cities who implement checks.  </span><span style="font-size: 11pt; line-height: 115%;">“Consistent enforcement by local law enforcement supports the community norm that those who sell and serve alcohol must do so in a way that does not contribute to community problems,” said Sergio Saldivar of the <span id="lw_1282851590_6" style="background: none transparent scroll repeat 0% 0%; cursor: hand; border-bottom: medium none;">Texas Alcohol Beverage Commission</span>.  The </span><span style="font-size: 11pt; line-height: 115%;">SEHCC will follow up with these stores by implementing a Responsible Beverage Service Campaign. </span></p>

<p> Although you wouldn’t know it from the temperature, another summer is heading into the history books as surely as children head back into the classroom. After a phenomenal inaugural season with over 60,000 visitors, Pirates Bay Waterpark will cease summer operating hours this Sunday, August 22. Beginning Saturday, August 28, Pirates Bay will be open every weekend from 11 a.m. – 7 p.m.   The park will remain open on this schedule through October 31.</p>

<p>“Our patrons are heading back to school, and so are our lifeguards, but with the continuing hot weather that tends to linger in our area long after the calendar says its fall, we aren’t quite ready to call it quits for the season,” said Scott Johnson, Parks and Recreation Director. “With this being our first year of operations, we’re still adjusting the schedule to meet the availability of our lifeguards and the demand of our visitors.”</p>

<p>Admission to Pirates Bay is $15, reduced to $12 for those patrons under 48”.  After 4 p.m., admission is discounted.</p>

<div>Despite widespread evidence that red light cameras actually increase accidents many cities like Baytown and Houston continue to cling to the revenue generating red light camera program. On 8-24-2010 the <span id="yiv442380908lw_1282228059_1" style="cursor: hand; border-bottom: #366388 2px dotted;"><span id="lw_1282253901_1">Baytown</span></span> city council is expected to officially place our petition to ban the red light cameras in Baytown on the Ballot for a November election. The council also has the option of adopting our ordinance immediately without an election. In light of this new information that demonstrates no safety improvement and increased accidents at camera monitored intersections we urge the council to immediately adopt our resolution and break their contract with the red light camera company that has engaged in numerous examples of voter intimidation and spent over $230,000 to fight the citizens of Baytown and Houston to keep the issue off the ballot. <p style="margin: 0in 0in 0pt;"><span style="font-size: 12pt; font-family: 'Palatino Linotype';" lang="EN">BAWA uses chloramines (a combination of chlorine and ammonia) as its primary disinfectant. <span id="lw_1282253901_1">Chloramines</span> provide a stable, long lasting residual within the water distribution system. This maintenance effort by BAWA and the City of Baytown , will maintain optimal water quality. The water quality from BAWA is consistently rated “ Superior ” by the State of Texas , the highest quality rating available. This procedure will enhance <span id="lw_1282253901_2">water treatment</span> and improve efficiency by reducing the amount of system flushing required.</span></p>
<p style="margin: 0in 0in 0pt;"><span style="font-size: 12pt; font-family: 'Palatino Linotype';" lang="EN"> </span></p>
<p style="margin: 0in 0in 0pt;"><span style="font-size: 12pt; font-family: 'Palatino Linotype';" lang="EN">“Free chlorine, while totally safe to the consumer, is stronger than chloramines as a disinfectant,” said BAWA Superintendent Steven Fife. During this procedure, the system will operate as normal, with the exception of the disinfection process. This is a procedure that BAWA will repeat every three to four years or as necessary to maintain system levels.</span></p>

<p style="margin: 0in 0in 0pt;"><span style="font-size: 12pt; font-family: 'Palatino Linotype';" lang="EN">“<span id="lw_1282108773_3">School zone</span> and bus laws will be rigorously enforced as part of the department’s zero-tolerance policy,” said Police Chief Keith Dougherty. “These laws were enacted to protect our children so drivers should expect to be issued a citation if caught going even just a few miles over the posted <span id="lw_1282108773_4">speed limit</span>, or passing a school bus while it is loading or unloading.”</span></p>

Children sometimes become distracted and aren’t <span id="lw_1282108773_5">paying attention</span> to the traffic, especially when they are running to their parents’ cars or talking with friends.</span><span style="font-size: 12pt; font-family: 'Palatino Linotype';" lang="EN"> </span></p>

Drivers should pay attention to all posted speeds and follow any directives issued by police or crossing guards. Those who break the law can expect the fines to be steep. Both are Class C misdemeanors, with fines of up to $500.</span></p>
